Dear Homeowners.
We want to thank those Association Members who attended the recent informational meetings to discuss the proposed Restated CC&Rs, as well as those who submitted their comments separately. The discussion and comments were very productive, with Association Members providing input that could make the Restated CC&Rs even better.
Based upon the input received, the proposed Restated CC&Rs have been amended. A “redlined” copy of the proposed Restated CC&Rs is linked to this notice for your review. The underlined language has been added to the Sixth Draft, which was sent to all Members on August 9th. The language that is crossed out has been deleted from the Sixth Draft. These “redlines” create the Seventh Draft of the proposed Restated CC&Rs. A “clean” copy of the Seventh Draft of the proposed Restated CC&Rs is also linked to this notice
We are now pleased to begin the voting process to adopt the Seventh Draft of the proposed Restated CC&Rs (“Restated CC&Rs”). In order to adopt the Restated CC&Rs, we need the approval of at least 75% of the Association Members, and all of the mortgage holders. Accordingly, it is extremely important that you review all of the documents and material that you were sent on September 30th.
We realize the Restated CC&Rs are quite lengthy. However, we urge each and every Association Member to participate in this very important process by reading the document in its entirety. After reading the document, please submit your vote using the Secret Ballot that was included in the material that you were sent on September 30th by no later than the start of the 2011 Annual Meeting on Thursday, December 8, 2011 at 7 p.m.
Since we also have to obtain the approval of all mortgage holders of the Restated CC&Rs, please provide us with your mortgage holder(s) contact information, if applicable, on the form that was also enclosed in the material that you were sent. Providing this information to us will save the Association time, and more importantly, money, as obtaining this information by other means can be quite costly. If you have already provided the Association with this information, there is no need to provide it again.
Please note that the Board of Directors reserves the right to extend the deadline date by which Secret Ballots are to be returned by providing written notice of such extension.
